This case was related to instructions given by the Client to the Consultant and several Main Contractors on a project to wave certain action stipulated in the contract agreements to be under the responsibility of the Consultant and contractors. The compliance with the Clients instruction has resulted in damages of various degrees to the completed structures, rendering some of them un-inhabitable.
Claims were under preparation, which I was involved in its preparation, attending meetings with the in-house lawyers, external lawyers and international expert, as well as replying to the in-house and external lawyers’ requests. Also I was responsible for coordination with the international experts and to provide to then the information and documentation requested by them, and similarly to other departments within the organization. The case was stopped based on an opinion presented by me to the lawyers and the organization in connection with the possible monies to be recovered from the Consultant based on his Professional Indemnity stipulated in his Contract, versus the amount that should be claimed from him, which was found not to in the Clients favour. Since this major case was dropped, after more than one year of working on it, I feel it is not advisable to state the names of the parties involved.
