[Note: Appendix 4-1 upon request - Letter from Mr. William Hadley of Sogex International ref. 9084/WH/mf, dated 17 December 1984]This case started in 1979 where claims were submitted by the structural steel subcontractor Cleveland Bridge Engineering (CBE) during the design, fabrication, production, shipping and constructing of the Works, and counter claims were prepared for SOGEX International SARL. As the dispute was not resolved amicably, the matter was referred to arbitration. This case was related to disputes under subcontract agreement for the design and fabrication in the UK, and the delivery of the Works and its erection in Jeddah, Saudi Arabia, of structural steel buildings and structures.
My involvement in this case was during 1978-79, while I was responsible f the design of the Works, when the disputes were discussed during the performance of the work, then again after the completion of the works on site from 1981 till December 1984.
During the latter period, I was involved in the preparation of the technical counter claim, discussing the disputed items with the Claimant in an effort to resolve the outstanding issues amicably, however this did not materialize and the dispute was referred to arbitration where my involved continued till the case was closed in December 1984.
During the arbitration stage I was involved in responding to the lawyers and arbitrator, attending meetings with both of them, providing arguments and counter arguments, discovery process, and the resolution of the case.
